Violation of the Fourth Amendment – Case dismissed
Case Conclusion Date: August 5 2013
Practice Area: Criminal Defense
Outcome: MOTION GRANTED CASE DISMISSED
Description: Skokie Courthouse (Case # 13 CR 284601)
Our client was pulled over for failure to activate his headlights. The arresting officers searched his vehicle and discovered methamphetamine. We argued that the vehicle our client was driving (year 2013) had headlights that turned on automatically upon starting the engine. The Judge found that our client’s seizure violated the Fourth Amendment and suppressed the drugs. The State subsequently dismissed the case.
