Client was stopped for swerving out of her lane. The arresting officer smelled alcohol and noted slurred speech. Client subsequently failed her field sobriety tests. Our office argued that the field sobriety tests were not properly administered due to our client wearing heels which exceeded two inches in length. Our office further argued that our client appeared mentally attentive and coherent. The Judge found that the State failed to meet its burden and entered a finding of not guilty on the DUI charge.
