Our client was accused of driving under the influence of alcohol after he was involved in a vehicle collision and failed standardized field sobriety tests. Our office offered evidence that our client had a prosthetic ankle which hindered his balance. After considering the defendant’s physical ailment the Judge found that his inability to pass the field sobriety tests may have been due to his prosthetic ankle and not as a result of alcohol consumption. The Judge rendered a verdict of not guilty.
